I dont think this means anything. With the huge influx of AP and EAD applications - I am quite certain that the last thing on USCIS's mind was making sure that the LUD was kept updated for the 485 apps. The important thing is that you have your 485 receipt and that is the acknowledgment that they have recieved the application and its in order.

HI All,
I currently work for a desi consulting company and applied for H1B Extension.I applied H1B Extension with Current Client Letter and also a copy of PO.But my contract may end in a month or so.I am near to finalising a new contract oppurtunity which if seleted needed to join immediately.Now if i change the job does it effect my pending H1B extension.

I applied I-140 in EB2 NIW category. I need to apply for H1 extension as this is my 5th year. I need to talk to my employer.

I am planning to visit India for a10 days in October. I have a valid h1b status till 2010 which I thinking of getting stamped at new delhi. But it seems the PIMS verification delay is making people wait for weeks and months. I have an AP which I can use to enter as an alternative. But I wanted to know if anyone had experience in stamping at the delhi consulate? Do they keep the passport if it is send for PIMS verification? In that case I'll drop the idea of getting it stamped and use my AP (though I want to avoid doing that snce I want to maintain my h1b status).

Hello everyone,

Can anyone look into this and suggest me ??

My Wife is planning to go for COS H1B to L2(i am on L1) due to the Job market.As suggested by a person in the forum i am planning to file COS E-filing from H1B to L2 and EAD while in USA.

So My Query is

1) Do we need to wait for L2 to be approved before she can leave the country ?? Or just we file L2 and EAD and she leaving country and come back on L2 with stamp once it is approved(i would like to send L2 Approval by Post)
2) What is the process of L2 Stamping in India after recieving approval notice (what are the documents needed) and how long does it take
3)Will above process effect her EAD progress ??

When a nation can't solve the problems that concern its citizens, it's in trouble. And that's where America now finds itself on nearly every big issue -- from immigration to Iraq to health care to anti-terrorism policies.

Let us focus on the last of these logjams -- over the legal rules for conducting surveillance against terrorists. There isn't a more urgent priority for the country: We face an adversary that would kill hundreds of thousands of Americans if it could. But in a polarized Washington, crafting a solid compromise that has long-term bipartisan support has so far proved impossible.

People who try to occupy a middle ground in these debates find that it doesn't exist. That reality confounded Gen. David Petraeus this month. He thought that as a professional military officer, he could serve both the administration and the Democratic Congress. Guess what? It didn't work. Democrats saw Petraeus as a representative of the Bush White House, rather than of the nation.

Now the same meat grinder is devouring Mike McConnell, the director of national intelligence. He's a career military intelligence officer who ran the National Security Agency under President Bill Clinton. As near as I can tell, the only ax he has to grind is catching terrorists. But in the vortex of Washington politics, he has become a partisan figure. An article last week in The Hill newspaper, headlined "Democrats question credibility, consistency of DNI McConnell," itemized his misstatements and supposed flip-flops as if he were running for office.

What's weird is that the actual points of disagreement between the two sides about surveillance rules are, at this point, fairly narrow. McConnell seemed close to brokering a compromise in August, but the White House refused to allow him to sign off on the deal he had negotiated. The Bush strategy, now as ever, is to tar the Democrats as weak on terrorism. That doesn't exactly encourage bipartisanship.

A little background may help explain this murky mess. Last year, after the revelation that the Bush administration had been conducting warrantless wiretaps, there was a broad consensus that the NSA's surveillance efforts should be brought within the legal framework of the 1978 Foreign Intelligence Surveillance Act (FISA). And in January, with a new Democratic Congress sharpening its arrows, the administration did just that. It submitted its "Terrorist Surveillance Program" to the FISA court. The heart of that program was tapping communications links that pass through the United States to monitor messages between foreigners. A first FISA judge blessed the program, but a second judge had problems.

At that point, the Bush administration decided to seek new legislation formally authorizing the program, and the horse-trading began. House Speaker Nancy Pelosi led a team of Democrats bargaining with McConnell. The administration had two basic demands -- that Congress approve the existing practice of using U.S. communications hubs to collect intelligence about foreigners, and that Congress compel telecommunications companies to turn over records so they wouldn't face lawsuits for aiding the government.

The Democrats agreed to these requests on Aug. 2. They also accepted three other 11th-hour demands from McConnell, including authority to extend the anti-terrorist surveillance rules to wider foreign intelligence tasks. Pelosi and the Democrats thought they had a deal, but that evening McConnell told them that the "other side" -- meaning the White House -- wanted more concessions. The deal collapsed, and the White House, sensing it had the upper hand, pushed through a more accommodating Senate bill that would have to be renewed in six months.

The summer negotiations left bruised feelings on both sides -- that's the definition of political negotiations in Washington these days, isn't it? McConnell fanned the flames when he told the El Paso Times that "some Americans are going to die" because of the public debate about surveillance laws. The Democrats threw back spitballs of their own.

Now McConnell and the Democrats are back in the cage. A key administration demand is retroactive immunity for telecommunications companies that agreed to help the government in what they thought was a legal program. That seems fair enough. So does the Democratic demand that the White House turn over documents that explain how these programs were created.

A healthy political system would reach a compromise to allow aggressive surveillance of our adversaries. In the asymmetric wars of the 21st century, the fact that America owns the digital communications space is one of the few advantages we have. The challenge is to put this necessary surveillance under solid legal rules. If the two sides can't get together on this one, the public should howl bloody murder.

Hi Folks,

Can I travel on a valid / approved AP when my H1 Extension is in progress. This is my
situation:

Valid AP in Hand valid till next year.
H1B expiring 6/20/2011
H1B extension applied on 4/7/11 have rcpt notice.

My questions are this:

1.) When I enter US back in with my AP in mid July will that impact my H1B extension in any way.

2.) Without any EAD will I be Jeapordizing my AOS in any way.

I will be continuing to work with the same employer who is the sponsor of my current
I485.

Request your thoughts and inputs on this situation. Appreciate any replies/advices you may have.

There is no AP renewal. You can apply AP later if you are not planning to travel. But AP is for travel during emergencies. It takes time to get the AP approval. Hence people keep it current all the time.

I'm working on L1 & have H1 petition without COS.

Can my H1 employer apply for COS, so that I can change my status from L1 to H1 without visiting India?

Also, I've an offer from a third company... can this company file for Change of Status from L1 to H1 & transfer the H1? I've the H1 petition I129 number, but no paystubs on H1. I've paystubs on L1.

Can I transfer to H1 to this third company? Will I have to get my H1 stamped frmo INdia then join this third company?

If not, is there any other option?

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

WHERE'S the fun? That's the feeling you get watching the Democrats in Washington this summer. Gone is the happy plan for a frenzy of lawmaking, the "Hundred Hours" of action Speaker Nancy Pelosi promised when the Democrats took the House. The speaker's artful allusion to Franklin D. Roosevelt's "Hundred Days" quickly became an ironic echo. During that first euphoric legislative period, Roosevelt managed to rescue the banking system from disaster, assist bankrupted farmers, rewrite the economics of agriculture and the rules for flailing businesses, bring back beer � you name it. Contemporary leaders can't even act on pressing issues such as agriculture and immigration, not to mention Social Security.

Why can't politicians be Roosevelts today? For an answer, let's look to the middle of 1935, about two years into FDR's New Deal and the equivalent of about now in the election cycle. The federal government was still smaller than the nation's state and local governments combined. Two out of 10 men were unemployed. FDR took the economic emergency as a powerful mandate for further lawmaking. He jumped into the project with all the glee of a boy leaping into a sandbox. The papers reported that he was going to "blast out of committee" yet another round of bills, and blast he did � that year the country's premier labor law, the Wagner Act, was passed, as was Social Security.

At about the same time, Roosevelt slapped together the Rural Electrification Administration, which came on top of the New Deal's large farm subsidies. For construction workers, artists and writers, he created � also in mid-1935 � the Works Progress Administration, which hired the unemployed, including artists, craftsmen and journalists. To appreciate the size of that gift, imagine a contemporary politician responding to a market crash by putting ex-employees of Google on the federal payroll. The president also built on to an already large structure, the Public Works Administration, which funded town halls, grammar schools and swimming pools in 3,000 counties. The money? Roosevelt passed a tax increase that opponents called the "soak the rich" act. It contained an estate tax rate hike that would make John Edwards drool. By 1936, the government took up more than 9% of gross domestic product. For the first peacetime year in U.S. history, Washington had edged past the state and local governments in size to become a larger part of the national economy. (Just a few years earlier, state and local governments had been twice as large as Washington.) FDR had reversed the old crucial ratio of federalism, and Washington has dominated the country ever since.

Those early commitments set a trend of promises. Some of them became what we now call entitlements. Lyndon Johnson in the 1960s layered on governmental commitments with the Great Society. President Bush has heaped on more, with a new entitlement: prescription drugs for seniors. Only a narrow part of the federal budget remains for discretionary spending � the part left over for new ideas. And setting aside the question of whether an individual program is good, bad or simply in need of an overhaul, we've found as a country that old commitments are simply too hard to undo.

This is partly because of the way the political game works. When you seek to take away a benefit from one targeted recipient, he will fight like crazy to keep it � think of the ferocious battles the farm lobby wages over even tiny reductions in agricultural subsidies. Those who gain from reducing the size of the handout, however, are members of the lobbyless general public who will receive only an incremental advantage, maybe the equivalent of a penny or two apiece. So the rest of us don't have the incentive or ability to apply countervailing pressure. Yet that's exactly what we need today: the energy and exhilaration of FDR in his first term.

Today's timidity would have disturbed FDR, who had no trouble knocking down the sandcastles he had made. Early in the 1930s, he created 4 million jobs with the Civilian Works Administration, then uncreated them when he decided the CWA was too close to the English dole. When he tired of Harold Ickes' Public Works Administration, he scaled it back, and finally abolished it in 1941. As for Ickes' Department of the Interior, FDR decided that it was time to revise it into "a real Conservation Department" � a change many would welcome today.

A few leaders since FDR have persuaded Congress to help them bring about changes on this scale � Ronald Reagan's bipartisan tax reform of 1986 and Bill Clinton's welfare reform a decade later come to mind. These presidents were truer to FDR's spirit than the hesitating Congress of today. Clearing some blank space for new institutions is possible. But lawmakers won't do it if they honor Rooseveltian edifices more than Roosevelt did himself.

My employer filed for my H-1B in premium processing, but it got denied because lawyer submitted wrong EIN number.

My questions are:

Will they re-consider my case if lawyer submits the correct EIN number?

How much time will it take to process, if the willing to re-consider the case?

Hello,

My priority date is October 2007. I got my I-140 denied , based on EB2, on the basis that the 5 years of education does not equate to the 6 years the USCIS believes is required for a Masters degree.
My lawyer got an education evaluation done and filed an appeal withing 30 days , in January 2008. The appeal has been pending since then.

I need advise on what to do next? Should I apply for another I-140? Can I somehow get the appeal decision expedited?

Hi all, I have a question regarding my current situation. I'm currently working for this non-profit organization under my OPT that is good until the end of Oct of this year. My question is basically whether or not I can ask my employer (already agreed) to petition for me for an H1-b visa? Can I still apply right now before my OPT expires or would it be better to apply next year on the first day of April? If I can get an approval for my H1-b would it be good to get a TN in the meantime and later have my employer petition me for an h1-B then?

Any suggestions would be greatly appreciated as I don't want to waste the opportunity to apply if I can get one at this time. I heard is better and easier to apply for one while under OPT than TN to H1-B but I'm not sure or rather confused about this!

You cannot file 485. You will have to start the process from scratch. However, you can use the priority date from the approved 140.

Can somebody help me on this one:

Regarding the receipt notice of I-485: which is the difference between the receipt date, receipt number and receipt notice.....from my understanding....the receipt date is when your I-485 application hits Uscis and the receipt notice is when the Uscis is really opening your package and looking at it?

Is it safe to travel( with valid H1b) knowing that your file hits the Uscis...or you have to wait for the receipt notice( now with so many filers for July, is it true that Uscis will send the receipt notice very late, maybe months, I mean later than the June filers.)?

Is it safe to travel after you file for I-485 and before getting the receipt notice....hoping that the receipt will come after you returned to U.S?

Thank you so much...I'm so confused about this receipt notice, I didn' find any law regarding this, that you can not travel witout receipt notice.

My lawyer selected option "a" in section 2 of I-485 for I-140/I-485 filed concurrently. Some members are saying that their lawyer selected option "h". Can some one tell me what must be the correct option for concurrent filing? If option h is correct, Is it possible to amend the existing petition?

Go ahead. By the time labor and I-140 gets approved, it could be close to two years based on current processing rate. At that time you will have a much better picture and can decide whether to file the I-485 or not. If the employer is willing to sponsor, why not?
