I am on H1B and planning to go for CP. I have to fill the form DS-230 for this and submit to VSF office.
Currently I am on H1B extension and I don't have visa stamped for this extension on my passport.
In this form DS-230 I need to fill field name "Present Address".
I have following question:
- In this form what should I fill my present address
Indian address
OR
US address.
(what I think: I think when I will submit the forms to VSF I will be in india and at that time i will not have the valid visa to enter USA. So I think I should fill the indian address.)
What do you guys suggest?

Employment letter is required at time of filing. If it is not there, your application might get rejected

We filed a H4 to H1 Change of Status petition for my wife. The file was opened and processed by USCIS and a RFE was issued. Due to some family situation, we had to withdraw the H1 petition instead of replying to the RFE.
My question is: Is the security/anti-fraud fee ($1500) returned by USCIS in such cases. We applied through a big consulting company.

My EAD and AP have the wrong birth date and I just noticed it. I have to re-send form I-765 and I-131 with the original EAD and original AP for correction. My case was originally filed in NSC along with 485, but I live in Texas.
But, as per instructions for I-765 and I-131, form should be filed at:
"Service Center with jurisdiction over your residence or Local Office - depending on where your case is pending."
Can someone guide me please ? Where should I file - TSC of NSC ?

is it possible and advisable to convert H1 B to H4 and go on searching for job and if find a job then coming back to H1? Are there any risks in this process? if so can some one explain me in detail?

CPA is not something thats awarded as a graduate degree by an accredited university. So probably no.
But make sure you are not shutting your option by talking to an immigration lawyer and finding out for sure if you are qualified.

My PD is Jun 2008 and my I140 is approved in April 2009 in EB2. My employer and lawyer did not give me any paperwork regarding Labor or I140 so I know details about Ad, Job Title or Description and stuff like that. If I want to transfer my H1 and keep the Priority Date, how can I know these details. Will it be a problem if I dont have these details.

Hi all,
I had my h1 issued in nov '09 and was laid off from the company in march '10. However, I was able to secure other position in the same company a month later. But now the company wants me to exit/re-enter the country (and get my visa stamped) before starting the new position.
Since I was technically out of status for the month of April (and don't have any paystubs for the same), will it be difficult to get my h1 visa stamped? Also, can I get my stamping done in Canada, or will I have to my home country?

hi,
I am unmarried son of citizens of usa and have my priority date current.I filed for I485 adjustment of status to permanent resident, which earlier got rejected,but then on refiling,I got a MSC receipt number saying next process is biometrics
My question is that as I am presently on student visa and my classes are starting from august 17th.Do I still need to maintain my student visa status and enroll in 12 minimum units,or is it ok If I don't enroll and just wait for my further case processing,and I won't be considered out of status as my I-485 adjustment of status is being processed?Is there still chance of my I-485 being denied(I don't have any criminal or any wrong record and maintained my status prior to filing my I-485 adjustment of status).Please guide whether to still enroll in 12 units and be on student visa or is it ok if I don't enroll as I no more want to pay high fees but,am worried about maintaining my status.

If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.
If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

I have 3yrs degree(Microbiology) and one year postgraduation diploma in computer science and 9years of work experience, Can I apply on EB2, some peolple saying at I-140 stage it gets problemetic with your degree, my employer says you can eligible to apply on EB2, Iam in real dilama, can any one please help me... thanks
