    But when i am told that I dont have access to this thread or that thread because I am not a donor...I do have the right to question if this organization actually represents all immigrants or just the donors?? If the motto of IV becomes "Change for fairness and justice (For Donors Only)" then it would make a lot more sense to me.

    I did like the idea of "earned" access to forums. So if someone has sent "X" no. of faxes through IV or contributed by actively and noticeably and is recommended by "X" no. of people they should have access to paid forums for a defined timespan (eg. earn 1 months access by sending faxes) Letters are not really verifiable so not adding this here. Going the earned path would not alienate many members who may not have contributed recently - but nevertheless are still contributing otherwise. People who have contributed in the past can be retroactively given access for a month for every $25 they've contributed.

    Sorry that I could not reply sooner. In this case, I went ahead and did an Info Pass appointment. The officer there went ahead and gave a 1-year temporary stamp and said he was ordering card production. This was in July and I am still waiting. My lawyer said "congrats"! No idea how to handle this going forward. What happened to your case?

    Well, I had the same situation. Me and my wife, we both received our green cards one fine day. Needless to say I was overjoyed for few days until my attorney called and explained the cons. He told me that this was clearly due to clerical error. Legally, they cannot approve your petition until PD is current. There are some new QC systems in place at the CIS and you should not risk your status if you have an honest intention of staying in this country.

    He said CIS can come back any day and revoke the green card if the system realizes that your card was illegally issued. At that time you may not have any option but to return to your home country within days.

    So, my attorney contacted AILA and through them got hold of the immigration officer who had approved my case. CIS immediately recognized the error and asked me send the cards back so it can be destroyed. I finally got a letter from the Director of Homeland Security apologizing for the error and appreciating my honesty (well I wasn't that honest really, it was my attorney who brainwashed me).

    On a lighter note � I took a photocopy of my green card and kept it in file; I stare at it sometime when I am frustrated�.

    What does the introduction of SKIL bill in House mean to us? i.e. what are the likely scenarios from here on? Thanks in advance.

    It seems tough to have this being passed unless CIR dies. Only 10 weeks are left for any bill to be debated and passed by both houses. In my opinion it is very difficult. I would personally wait to hear opinion about this bill by legal experts and media. It is too early to speculate on its failure or success.

    btw. If Uma Thurman endorses this Skil Bill it will definitely get passed!!

    sagar_nyc, agreed. EB3 is a joke and even worst I have become a joker in front of all my friends who applied in EB2 cheating the system. Funny is, experience wise, I am well ahead of all those making fun of me but...:-(

    too bad, eb3 does not even have a place to vent these days as IV forums and its thread only has discussions from EB2 members.

    This has really become a joke.......EB2 India had 3,341 applicants in March-2005 and it has moved to OCT 2005 so that means 6869(from March-2005 to Oct 2005) EB2 nos are available....how is that possible (based on the 7% of 140,000 divided into 3 cateogories which is 3200 each for EB1 , EB2 and EB3) ...whereas EB3-I only moved to Nov 22nd ....come on give me a break.....THIS IS ABOSOULTELY BULLSHIT.....

    We need to do something for sure. I know that most of EB3 folks are stuck for GC more than 7-8 years. I don't see any good progress for EB3 in the future.

    I would request from everyone to wake up and take a proactive step. I am ready to give any kind of support.
    The problem is most of the EB3 people are happy with their EAD's. and I guess since EB2 looks promising now - they wont care much about EB3 or retro ..so I dont think anybody is going to wake up. maybe we should go to sleep too :)

    At the end of the day, no matter what anyone says or thinks of me, I still don't have one good reason to learn Hindi! Yet, I am a Proud Citizen of Indian and there is nothing that people like hpandey or ameryki can do about it! This is the truth and so will it remain!

    Is there anyway we can work on reporting fraud desi consulting companies to the USCIS so the fraud EB applications can be cleaned up from the system? That may help in clearing up the backlog. Believe it or not, many fraud desi firms have sponsored people in EB-2 successfully. I have worked with many such IT 'professionals' who can't speak a word of English and hardly have any idea what's going around them. I am serious here, this should be considered and evaluated. No offence meant to anyone but those who have had a wonderful educational background and don't work for desi 'firms' ought not to worry since this doesn't target them at all. I am just tired of fellow country men/women who have diminished our country's image, especially in the IT industry and am trying to think of solutions in addition to what we already have on IV's agenda.

    Merits based point system awards supplemental points for illegals. Being illegal is not an accomplishment. Having an MBA or MD is. The two cannot be awarded merits on the same scale.

    Merits based point system works well in countries that dont have annual caps. Like Canada. Their objective in Canada is to fill the country with younger working population in order to balance to demograph that is headed to an aging population. USA is not like that and having points system in conjunction with numerical caps will cause greencard to go to paper-tiger resumes that have lots of points but not employable. There are millions of Ph.Ds in Science in India and China and they would not be employable here but would get GCs. Just like Canada, we would have greencard holders with Ph.Ds and MBBS driving cabs. Employability has nothing to do with papers that prove how many years you spend on colleges accumalating degrees.

    A bachelor's degree from Harvard and a Bachelor's degree from Rutgers would get same points : 16 points. Is that really a measure of merits?

    But again, if you feel that point system is great, issue press release on your own and peddle your agenda on your own but dont use this site to peddle that agenda. You are free to discuss with other members but dont issue press release and dont speak to the media on behalf of IV. Speak to the media as an individual.

    Also, if you feel that IV is run by non-US educated consultants and the US educated employees are not represented or served by Immigration Voice, then please start your own organization to represent them and I will be happy to point the dissatisfied US educated members in your direction. For once, I would love to share the burden with others and if we have 2 organizations instead of one, atleast we can share the work load. So please, do start your website, your organization, your advocacy etc and take away members from us who are dissatisfied with IV and who feel that US educated folks need more representation and your organization could potentially provide that.

    The position of immigration voice on points system is very clear and it will stay that way.

    Besides the points system, you should look at other aspects of the bill. Being US educated from top University, I am sure you will have no trouble in interpreting title 4 and title 5 of the bill. They are striking down AC21 provisions that provide extensions of H1 after 6 years based on pending labor for 1 one year or pending 140. And they are replacing it with pending immigration petition for 1 year as requirement for H1 extension. What that means is that there will be extensions granted to only those who have filed for 140 before May 21. After that, the 140s filed or approved would be invalid and they would have to wait for points system. And points system doesnt kick in until Oct 1 2008. So during the 1 year blackout period, between the President signing the bill and Oct 1 2008, there will be no immigration petitions filed. Old system will stop accepting 140 and new system (your favorite merits system) wont kick until Oct 2008. Combine that with removal of AC21 provisions for extensions of H1. There are tens of thousands who will be unable to extend their H1. These are the folks who are either in backlog centers or who have filed PERM but not filed 140 as of May 21 2007. Can you imagine the catastrophe? Go thru title 4 and title 5 and see the sections of INA it is amending.

    I know IV is doing its best and there are other groups fighting for HR 5882.

    But honestly, what are the chances for this bill to succeed this year (before election)?

    100% or 75% or 50% or 25% or 0%

    Ron Gotcher predicts that none of the individual bills may pass this year.

    And also that EB3 I may not move forward even next year!

    I am not sure how many EB3 (I) volunteers are there in IV (who are really focussed). Are they getting nothing? The prediction is that EB3 I may go back to Nov 2001 and stay there for a while (or may be for the rest of next year).

    Is the efforts of EB3 (I) volunteers being exploited (indirectly, ofcourse)? What are they fighting for?

    If a mountain looks high, you just don't give up if you really want to summit.
    Hence, my friend, we all have to try...remember that old saying ...Try and Try .... Till You Succeed.

    There is nothing to loose, but if this clicks, everybody is a winner.

    EB3-I will benefit (not all) but those who get the GC will move OUT of the line, clearing the way for others.

    That doesn't mean nothing is being done. I am continuing to do a lot of work on this, but there is nothing new to post right now.

    To date I have been able to get every newspaper in the country to do stories on this, as well as three scathing editorials in the NY Times, LA Times, and Mercury News, all of which slammed the government for its action.

    I have worked with the staff of a member of Congress to ensure that house representatives were aware of the issue.

    As a result, the house of representatives unanimously passed the HEART Act giving stimulus payments to affected soldiers overseas.

    I have been able to get an important legal organization to review and research the topic for possible litigation.

    I would love to go over the legal details with you, but it is not prudent to give too much detail here right now.

    And finally, I have been corresponding with immigrants like you providing advice and updates on the situation.

    I am not sure what more you expect.
