Hi,
Employee of company A accepts an offer from another company B which promptly applies for a H1B transfer premium processing and its approved. Now the employee cannot join company B due to some problem and wants to remain with company A. Does company A need to apply for H1 transfer?
As I understand there will be no need to apply for the transfer again and the employee can continue working for company A. But the tricky part here is what if company B cancels the employees H1 visa seeing the employee did not join its workforce (considering that it just transferred it)?
Can some knowledgeable people please comment on the above scenario please.

I am sure we are all rejoicing and this is surely a cause to celebrate.
But, the battle is not over yet. I hope once most of the members get their 485/EAD applications rolling, they will get back on track and fight for the real objective. To obtain our green cards in time!! Dont forget the wait is NOT over yet...
I am sure we all are going to be a lot rejuvenated and continue fighting retrogression with greater zeal..
Just to set the record straight even I benefit from the visa update, but I hope we dont slow down at this juncture...

This is an interesting development. It will create a clear division among supporters of CIR. It is so enticing to say,"who cares about CIR if we have SKIL" from our perspective. Hopefully this is a sincere effort not just some political posturing.

In a move that high-tech groups predict could break the impasse over immigration legislation, Arizona’s John Shadegg, a member of the House leadership, says he’ll introduce legislation to increase visas and citizenship opportunities for skilled workers.
The bill mirrors a Senate Republican-sponsored bill and would more than double the number of temporary visas and permanent green cards available to skilled workers each year. The bill also would make it easier for U.S.-educated foreign nationals to stay here after graduation and work in their field of study.
The measure is the first time Republican conservatives in the House have endorsed any immigration bill that didn’t deal solely with border enforcement. A Shadegg spokesman said some House members also favor passing a measure that makes more visas available to agriculture workers. He predicted that action could begin on both measures after Congress comes back from its summer recess — and after a long string of House immigration hearings has run its course.
That still leaves out a guest-worker program and some plan for dealing with illegal immigrants already here, but would inch the House closer to a Senate immigration-overhaul bill.
Judiciary Committee Chairman James Sensenbrenner (R., Wis.) has insisted he won’t permit any immigration bill to pass until border enforcement is tightened. If a measure that eases visa backlogs for highly skilled workers has to go through his committee, “that could be a problem,” says a Shadegg spokesman.
But high-tech groups say the bill shines attention on their need for skilled workers, and on what they call the dangers to U.S. competitiveness if more visas aren’t made available. “It lets us talk about our issue,” says the National Association of Manufacturers’s Sandra Boyd. –June Kronholz

Because of the retrogression, I am investing all my money in India rather than in America where the growth is higher and more certainity for me atleast for time being...

What freedom and justice you are talking about? The folks on this forum are not responsible for you misery. So stop venting you frustation here. Though, I sympathize with you situtation but unfortuantely the whole legal system is unfair.
What we have done here is a good start, soon we will lobby for passing of SKIL bill . And the day is not far when you too will be benefitted by these efforts

I'm aware of the IV efforts towards getting relief for BEC people, I never disputed that. My point has been that the system and July bulletin is unfair (at least from one angle) and that calling it unfair/unjust should not upset others. I don't know what words were used by Bigtime and banning him was fair or unfair.

You should make an appointment with info pass and carry all needed documents with you. They should be able to help. It is not perfect solution but it works. My wife had applied her AP which did not show up even after three months, in mean time we have had an emergency. I made an appointment with info pass, it was approved within a day. It is worth a try.

I do undersatnd that these companies did not help you.. y don't u understand that we r not talking about u :) the statistics r these companies bring tens of thousands here every year from one country, yes on H1 or L1, not to sponsor them for greencards, but arriving here with a dual intent visa that allows for greencard application is not such a casual opportunity and that's what I'm telling you is rarely available to the equally qualified non-retrogressed folks. Once here, those thousands transfer to these small/mid size companies u mentioned and choose to stay and apply for greencards even though they know that with their huge numbers current rules will make their greencard journey longer..

And besides these companies are all software cos that came up in the last 10 yrs, why should that stupid rule affect any person in a non-software field?
Yes we know that the current rules make the journey longer. The point is that it is unfair and that's why we should start trying to change it!

Ask your attorney to write a letter in response to RFE and explaining the situation you never took the job with employer X though the H1B transfer or new is approved, this will clear the query of USCIS. One catch, you should have maintained a continuous employment with #2 and demonstrate the same to USCIS. Good luck!
Note H1 to L1, H4 to H1, L1 to H1 is completely different, it is change of status - H1 to H1 is not change of status, so there is no question that you recent h1 is valid and past is invalid. Get an attorney, Good weekend
