I am one of the July filers, have EAD and applied for I485 EB3, Dec 2003 India. My H-1 And GC are both based on the job title- Systems Programmer/ Network Admin. I wanted to apply for a position in the university - Lab Director- Electrical & Computer Engineering. My question is :
1) Since not all the job responsibilities will be same in the new job (if i get it). but some ofthe requirements will be the same.
[like setting up the network, little programming devices etc.]
2) Can I apply for EB-2 with the university and later port my date- Eb3 to EB2
Pls let me know at your earliest convenience

Does the published cumulative demand data represent
a) all pending 485 cases that include primary applicants and their dependents
OR
b) all pending 485 cases that include primary applicants only?
If say, the demand data for EB3, till 2004 says 35,000 - does this mean there are a total of 35,000 pending cases in total OR does this represent primary applicants only?
If it represents primary applicants only, what is the multiplication factor we need to use to get an approximate number for total pending 485 cases?

My LC & 140 are approved under EB2 category. PD is Oct 2004. The same employer wants to promote and move me from New York to California.
The question is:
Can i file GC under PERM for the new role ( same company) in California. Assuming the PERM LC gets approved, can i port the PD of Oct 2004?

Hello,
There are lots of articles/news around this issue, but so far these have been exceptions than rule ... I myself entered US through a completely different airport than where I'm employed (on H-1B) and didn't have any issue.

To invoke AC21 after 180 days of pending I485, I140 does not have to be approved. But its risky as your I485 application is based on I140, if things go wrong with underlying I140 then your I485 case will be affected.
Please refer to Yates Memo for AC21.

I am planning to invoke AC21 and my new job responsibilities are an exact match with my current labor, but, the title is Database administrator.

When one applies for AP in Multiple entry category they will be given 2 AP dox. lets say if one has used both on travelling like both has stamp of POE can they reuse the same for future travel with in the one year period of validity ?
