Hi All,
My employer filed for my H-1B in premium processing, but it got denied because lawyer submitted wrong EIN number.
My questions are:
Will they re-consider my case if lawyer submits the correct EIN number?
How much time will it take to process, if the willing to re-consider the case?

Hi, Im a pediatritian from Venezuela. I was hired by a research institution to work for a year here in the US, and i was granted a H1b non clinical Visa about 3 months ago. A month ago I was offered a position on the fellowship program of Pediatric Critical Care at the same institution but they need to change my visa to a Clinical H1b visa. I went to all the process here in the US. I havent go to Venezuela to get my passport stamped but at the International Depatment of the Institution they told me that i can Travel to Mexico or Canada for less than 30 days without my passport stamped, no problem. I have plans to go to Mexico for Christmas. Now my question is:
Can I travel to Mexico with my first H1b visa aprooval while my other H1b visa is on process?

My six-year H1B expires Feb 2 2010.
My employer (company A) filed PERM with DOL on July 30 2009.
I have spent a total of 2 months outside the U.S while on H1B status.
I have been on bench since July without paystub.
I am leaving the U.S on October 30 2009 and am interested in returning back
through another company
Can I return to the U.S through another employer (company B) on a new H1B visa after Feb 2 2010... How long would that visa be valid for.
If I cannot get a new visa; can I add the total of 5 months spent outside
the US on the current h1b visa for recapture through another employer (company B) after Feb 2 2010 -- return to the U.S; and then
subsequently apply for a 1-year extension after July 31 2010
based on company A's PERM filing.

I have two I - 140s pending (say A and B)
I am applying I-485 for A (140)
If my I-140 for A gets denied can I change the I-485 to use I 140 from B later?
Or do I need to apply for I-485 freshly with I-140 from B?

Hi,
I m without an assignment for about 3 months, but I m maintaining my status bcoz the employer is running the payroll with minimum salary. mean while i m expecting a full time offer from a company and they are willing to transfer the visa. so my question is that when the new company will be asking for the paystubs for the transfer, I have the paystubs which have a reduced(minimum) salary than what I was earning when I had a project, so will it affect my job offer or any questions will be asked by USCIS?
i know the questions are pretty open, I would appreciate any replies/advice on this,

Immediately, Senate Republicans went on the attack. Senator Charles Grassley(R-Iowa) did not hesitate to invoke the dreaded "A word": "This memo give credence to our concerns that the administration will go to great lengths to circumvent Congress and unilaterally execute a back door amnesty plan." A "back door amnesty plan"? Whoa! Now, wouldn't that be a great issue for the Republicans in the November elections? However, Senator Grassley must be hoping that people will not take the time...

My wife quit the job last year she was on H1. and we didn't get any RFE till date..

Each year, the U.S. government makes 65,000 H-1B visas available to qualified individuals on a first-come basis. The cap has been reached every year for the last several years, and for fiscal year 2008, it was reached on the first day of filing. Labor category has little to do with AC21. Your responsibilties should be 'similar', which is kind of a vague term, which means USCIS would generally not mess with anything that has enough of the same words used in description.
